By accessing or using RevenuePeak at revenuepeak.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. References to "you" or "user" mean any individual accessing the Service.
RevenuePeak is a business intelligence platform that organizes, presents, and enables analysis of publicly available Texas hotel occupancy tax (HOT) revenue data. The Service provides tools to search hotel revenue records, view historical trends, compare properties, and analyze market data — for research, market analysis, and business intelligence purposes.
The Service is operated by RevenuePeak LLC, a Texas limited liability company.
All hotel revenue data displayed on RevenuePeak is sourced from public Hotel Occupancy Tax (HOT) filings maintained by the Texas Comptroller of Public Accounts. Under Texas Tax Code §156.155(b), this data is explicitly designated as public information under the Texas Public Information Act (Texas Government Code §552.002). The restriction in §156.155(a) on public posting applies only to state agencies, not private entities.
RevenuePeak organizes, normalizes, and presents this public record data. RevenuePeak is not affiliated with, endorsed by, or officially connected to the Texas Comptroller's Office or any other government agency.
To access the Service, you must create an account by providing your name, email address, and a password. You agree to:

Violation of these prohibited uses may result in immediate account termination and, where applicable, legal action.
The RevenuePeak platform — including its design, source code, user interface, features, and data presentation — is owned by RevenuePeak LLC and protected by applicable intellectual property laws.
The underlying Hotel Occupancy Tax data is public record owned by the State of Texas. RevenuePeak's compilation, organization, normalization, and presentation of that data constitutes a separately protectable work.
You may not copy, reproduce, distribute, or create derivative works based on the RevenuePeak platform or its compiled data presentation without express written permission.
Data accuracy. Hotel revenue data is sourced from HOT filings submitted by individual hotel operators to the Texas Comptroller. RevenuePeak presents this data as received from the Comptroller and makes no warranties, express or implied, about the accuracy, completeness, or timeliness of the data. Errors in original filings will be reflected in the data displayed.
Not financial or investment advice. The data and analysis tools provided by RevenuePeak are for informational and research purposes only. Nothing on RevenuePeak constitutes financial, investment, legal, or business advice. You should not rely solely on RevenuePeak data when making financial or investment decisions. Consult appropriate professionals for specific advice.
Service availability. RevenuePeak is provided "as is" and "as available" without any warranty of uninterrupted access, error-free operation, or fitness for a particular purpose. We do not guarantee uptime or availability.
To the maximum extent permitted by applicable law, RevenuePeak LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
RevenuePeak's total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the total amount you have paid to RevenuePeak in the twelve (12) months preceding the claim. If you have not paid any amounts, our liability is limited to $0.
You agree to indemnify, defend, and hold harmless RevenuePeak LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
Before initiating formal legal proceedings, you agree to first contact us at admin@revenuepeak.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving written notice. If informal resolution fails, either party may pursue claims in Travis County, Texas courts as provided in Section 11.
We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, suspected fraudulent or abusive behavior, or any other reason at our sole discretion.
You may delete your account at any time by contacting us at admin@revenuepeak.com. Upon termination, your right to access the Service ceases immediately.
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by updating the "Last updated" date on this page and by sending notice to the email address associated with your account. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the changes.
